Terms of service

These terms govern your use of Pushferry. Using the service means you accept them. Please also read the acceptable use policy, which is part of this agreement, and the privacy policy.
About the operator. Pushferry is currently operated as an independent service reachable at hello@pushferry.com, with its servers in Frankfurt, Germany. The registered company details and the governing law for paid subscriptions are being finalised and will be published on this page, with the effective date, before paid plans open. Until then this document describes how the service actually handles your data and what we undertake to do — which is the part that binds our behaviour today.
What the service is
Pushferry connects an Android phone you control to a cloud account, so that SMS and app notifications arriving on that phone can be forwarded where you choose, and so that messages can be sent from that phone's SIM through an API or the cabinet.
Note what this means: we are not a mobile operator and we do not carry your messages. Your operator does. We are software that drives your own handset.
Your account
You are responsible for keeping your password and API keys secret, and for everything done with them. Tell us promptly if you think a key has leaked; you can revoke it yourself in the cabinet at any time. One account is for one customer — a person or an organisation — and you must be legally able to enter into this agreement.
Your phone and your SIM
You must have the right to use the phone and the SIM you connect, and your use must comply with your mobile operator's contract. Consumer plans commonly forbid automated or bulk commercial messaging, and operators can filter, throttle or suspend a line that looks like a campaign source. That risk is yours, and nothing we provide removes it.
Message charges are between you and your operator. We do not carry the message and we do not bill for it.
Your content, and who is responsible for it
You decide who receives a message and what it says. You are responsible for having the recipient's consent where the law requires it, for the lawfulness of what you send, and for the timing rules that apply in the recipient's country. We do not read your message text and are not in a position to review it.
We do not claim any ownership of your content.
Plans, payment and cancellation
The free plan is free and needs no card. Paid plans are billed in advance for the period you choose and renew automatically until you cancel. You can cancel at any time in the cabinet; cancelling stops the next renewal and leaves your current period running to its end.
If we change prices we will give notice by e-mail before the change takes effect for you, so that you can cancel first if you would rather not continue.
What we do not promise
Delivery of an SMS depends on your phone being powered, connected and in coverage, on your SIM having credit, and on operators along the way. We cannot and do not guarantee that a given message will arrive, or arrive at a given moment. We aim to keep the service available and to warn you about planned maintenance, but we do not offer an uptime guarantee on the free plan.
The service is provided as it is. To the extent the law allows, we exclude implied warranties and are not liable for indirect or consequential loss, including lost profit or lost business. Where we are liable, our total liability for any claim is limited to what you paid us in the twelve months before it arose. Nothing here excludes liability that cannot lawfully be excluded, and if you are a consumer, your statutory rights are unaffected.
Suspension and closure
We may suspend or close an account that breaks the acceptable use policy, that we are lawfully required to stop, or that is not paid for. Except where the breach is serious or the law leaves us no room, we will warn you first and give you a chance to put it right. You may close your account at any time.
Changes to these terms
We may update these terms. The effective date at the top always shows the current version, and we will notify account holders by e-mail about material changes before they take effect.
